1. Agreement

These Terms govern your use of www.shovel.studio and any purchases or enquiries made through it. By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

3. Using the Site

You agree to use the Site lawfully and not to:

  • interfere with, disrupt, or attempt to gain unauthorized access to the Site or its systems;
  • scrape, harvest, or misuse data or content;
  • submit false information or use our contact and booking forms to send spam or abusive content.

We may suspend or restrict access if these Terms are breached.

4. Products, pricing, and orders

  • Products are sold through our store, with checkout and payment handled by Shopify.
  • Prices and availability are shown live and may change without notice. We make reasonable efforts to display accurate price and inventory, but errors can occur; we reserve the right to cancel or refuse any order affected by an obvious error.
  • An order is accepted only when confirmed at checkout. All sales, shipping, returns, and refunds are subject to our Refund Policy and Shopify's checkout terms.

5. Bookings and enquiries

When you book a call or submit an enquiry, you agree to provide accurate information. Bookings are scheduled through Calendly and are subject to availability. Submitting a form does not create a binding engagement; any project work is governed by a separate agreement.

6. Intellectual property

All content on the Site — including text, design, graphics, case studies, and code — is owned by Shovel Studio or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission. Third-party content displayed via Are.na or other embeds remains the property of its respective owners.

7. Newsletter

By subscribing, you consent to receive marketing emails. You can unsubscribe at any time using the link in any email.

8. Third-party services and links

The Site relies on and links to third-party services (Shopify, Mailchimp, Calendly, Are.na, Google, Meta, Microsoft). We are not responsible for the content, policies, or practices of those services.

9. Disclaimers

The Site is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, Shovel Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Our total liability for any claim is limited to the amount you paid us in the preceding 1 month.

11. Governing law

These Terms are governed by the laws of Wisconsin, United States, and any disputes will be resolved in the courts of Appleton.

12. Changes

We may update these Terms at any time. Continued use of the Site after changes means you accept the revised Terms.
